1. About these terms
These terms apply to the Scan2Care public website, pharmacy registration, free trial and service. Scan2Care is operated by InnovateRx Limited, company number 14671626 (“we”, “us” or “our”). By creating or using a pharmacy account, you confirm that you have authority to act for the pharmacy business and agree to these terms on its behalf.
If a signed order form, subscription agreement or data-processing agreement conflicts with these website terms, the signed agreement takes priority for the conflicting matter.
2. The service
Scan2Care provides digital patient-entry links, structured intake journeys and pharmacy workflow tools relating to Pharmacy First. Features may include QR materials, pharmacy dashboards, account administration and group reporting.
We may improve or change features to maintain security, comply with law or reflect changes to NHS services. We will take reasonable steps to avoid materially reducing paid functionality without notice.
3. Clinical responsibility
Scan2Care is a workflow and information-capture service. It does not diagnose a patient, prescribe or supply medicine, replace the pharmacist consultation, guarantee eligibility, or replace the current NHS service specification, clinical pathways, PGDs, professional standards or emergency services.
The pharmacy and its registered professionals remain responsible for reviewing information, identifying urgent or unsuitable cases, making clinical decisions, obtaining any required consent, keeping appropriate clinical records and completing NHS submissions or claims.
4. Registration and account security
You must provide accurate and current registration information, use an account only for an authorised pharmacy, keep sign-in details confidential and tell us promptly if you suspect unauthorised access. Accounts may not be shared in a way that prevents actions being attributed to the appropriate user.
We may verify pharmacy details using ODS and NHS organisational directory information. We may refuse, suspend or require additional verification where information is incomplete, inaccurate or creates a security risk.
5. Acceptable use
You must not misuse the service, attempt unauthorised access, introduce malicious code, disrupt availability, reverse engineer protected elements except where law expressly permits, send unlawful communications, or use Scan2Care in a misleading way. QR codes and links must identify the correct pharmacy and must not be altered to redirect patients elsewhere.
6. Data protection
Each party must comply with applicable data-protection law. Our use of website visitor, enquiry and pharmacy-registration information is described in the Privacy Policy. Where InnovateRx processes patient information for a pharmacy, the parties’ applicable subscription and data-processing arrangements govern that processing.
7. Trial, fees and cancellation
Unless a different offer is confirmed in writing, an eligible new pharmacy account receives the trial period shown when it registers. Current indicative monthly prices appear on the Scan2Care homepage; the price, billing date, taxes and payment terms confirmed during ordering or in a written agreement apply to the subscription.
You may request cancellation using the contact details below. Cancellation takes effect according to the applicable order or subscription agreement. Amounts already due remain payable, and statutory rights are unaffected.
8. Availability and support
We aim to provide a reliable service but cannot promise uninterrupted or error-free availability. Maintenance, internet failures, supplier outages, security incidents or events outside reasonable control may affect access. Report service problems through the Contact page.
9. Intellectual property
InnovateRx or its licensors retain intellectual-property rights in Scan2Care, including its software, design and supplied materials. We grant subscribing pharmacies a limited, non-exclusive, non-transferable right to use the service and supplied QR materials for their authorised business operations during the trial or subscription.
NHS names and materials belong to their respective owners. References to NHS services do not imply NHS ownership or endorsement of Scan2Care.
10. Responsibility and liability
Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to that, each party’s remaining liability is governed by any signed agreement between the parties and applicable law.
You are responsible for professional and clinical decisions, the accuracy of pharmacy-provided content and links, and using the service in accordance with law and relevant professional requirements.
11. Suspension and termination
We may suspend access where reasonably necessary to address a security threat, unlawful use, material breach or non-payment, and will provide notice where reasonably practicable. When a subscription ends, access may stop and information will be handled in accordance with the applicable agreement, legal obligations and our retention practices.
12. General
If part of these terms is unenforceable, the remainder continues to apply. A delay in enforcing a right does not waive it. Neither party may transfer its obligations without the other’s consent, except as part of a genuine business reorganisation or sale where rights are not materially reduced.
These terms are governed by the laws of England and Wales, and the courts of England and Wales have jurisdiction, subject to any mandatory rights that apply.
